TERMS OF USE
Effective Date: November 2, 2026
These Terms of Use (“Terms”) govern your access to and use of courses, educational materials, digital products, websites, and related services provided by Mindful Momentum Institute, a DBA of Wellness With April, LLC (“Mindful Momentum Institute,” “we,” “us,” or “our”).
By creating an account, purchasing a product, enrolling in a course, or using our services, you agree to these Terms.
1. Educational Purpose
Mindful Momentum Institute provides educational courses, continuing education programs, coaching resources, and related educational materials.
Our content is provided for educational and professional-development purposes only. It is not medical care, mental health treatment, psychotherapy, diagnosis, or individualized medical advice.
Nothing in our courses or materials establishes a physician-patient, therapist-client, or other licensed healthcare treatment relationship.
Participants are responsible for practicing within their own professional scope, training, credentials, applicable laws, ethical standards, and organizational requirements.
2. Continuing Education Credit
Certain courses may be approved by professional credentialing, certifying, accrediting, or regulatory organizations for continuing education credit.
When continuing education credit is offered, participants are responsible for meeting all stated completion requirements. These may include completing required instructional content, videos, quizzes, assessments, evaluations, or other course activities.
A certificate of completion and continuing education credit will be issued only when the applicable completion requirements have been satisfied.
Approval by one credentialing or professional organization does not guarantee that another organization, employer, licensing board, or jurisdiction will accept the course for credit.
Participants are responsible for confirming that a course satisfies their individual certification, credentialing, licensing, or professional-development requirements.
3. Course Access and Accounts
You are responsible for providing accurate account information and maintaining the security of your login credentials.
Your account and course access are for your individual use only unless we expressly authorize otherwise in writing.
You may not share your login information or allow another person to complete course requirements, assessments, or continuing education activities on your behalf.
We may suspend or terminate access if we reasonably believe an account is being misused, shared without authorization, used fraudulently, or used in violation of these Terms.
4. Course Completion and Certificates
Course completion requirements may vary by course and will be communicated within the applicable course.
Where a course offers continuing education credit, you must personally complete all required activities and satisfy applicable assessment requirements before receiving a certificate of completion.
Certificates are issued to the individual whose account is associated with the completed course. You are responsible for ensuring that your name and other relevant account information are accurate.
Misrepresentation of course completion, assessment results, continuing education credit, or certificate information is prohibited.
5. Intellectual Property
Unless otherwise stated, all course content and materials are owned by or licensed to Wellness With April, LLC and/or Mindful Momentum Institute and are protected by applicable copyright, trademark, and other intellectual property laws.
This includes, without limitation, videos, recordings, slides, written lessons, worksheets, handouts, downloads, coaching resources, assessments, graphics, frameworks, course organization, and other educational materials.
Your purchase grants you a limited, personal, non-exclusive, non-transferable license to access and use the materials for your own education and professional development.
You may not, without prior written permission:
Copy, reproduce, republish, upload, distribute, sell, sublicense, or commercially exploit course materials;
Share purchased downloads or course materials with colleagues, clients, employers, organizations, or other third parties;
Record, download, reproduce, or redistribute course videos except where downloading is expressly permitted;
Share account credentials or allow others to access paid content through your account;
Remove copyright, trademark, or proprietary notices;
Present our materials as your own; or
Use our materials to create or substantially reproduce another course, training program, toolkit, or commercial product.
Purchasing a course or digital product does not transfer ownership of the underlying intellectual property.
6. Coaching Resources and Client Use
Certain products may contain tools or resources intended to support your work as a coach or professional.
Unless a resource expressly states that reproduction or distribution to clients is permitted, purchase does not grant permission to copy, distribute, resell, sublicense, or provide the resource itself to third parties.
Any specific client-use license included with a product will govern how that resource may be used.
7. Payments
Prices are displayed at checkout and may change from time to time.
You agree to pay all charges associated with your purchase, including applicable taxes or fees.
Payments may be processed through Thinkific Payments or other third-party payment providers. Those providers may maintain separate terms and privacy practices governing payment processing.
8. Refunds and All-Sales-Final Policy
Because our online courses and digital products provide immediate access to proprietary educational content and materials, all sales are final and non-refundable once a purchase is completed, except where a refund is required by applicable law.
We do not offer refunds for failure to complete a course, changes in personal circumstances, dissatisfaction after accessing course content, or a participant's determination that a course does not meet the requirements of their employer, credentialing organization, licensing board, or other professional organization.
Participants are responsible for reviewing course descriptions, continuing education information, eligibility requirements, and applicable professional requirements before purchasing.
Digital products, downloadable materials, toolkits, templates, and other immediately accessible digital resources are also non-refundable once purchased, except where required by applicable law.
If a duplicate charge, billing error, or technical issue prevents access to a purchased product, please contact Mindful Momentum Institute so that we can investigate and resolve the issue.
Nothing in this policy limits any refund, cancellation, withdrawal, or other consumer right that cannot legally be waived under applicable law.
9. Digital Products and Downloads
Digital downloads and resources are licensed to the purchaser for the uses expressly permitted with that product.
Unless otherwise stated, digital products may not be shared, copied for distribution, resold, uploaded to shared drives or organizational systems, or distributed to employees, colleagues, clients, or other third parties.
Organizations wishing to provide materials to multiple individuals must obtain an appropriate multi-user or organizational license when available.
10. No Guarantee of Results
We strive to provide high-quality, evidence-informed educational content, but we do not guarantee any particular personal, professional, financial, business, health, coaching, certification, or client outcome from participating in a course or using our materials.
Your results depend on many factors outside our control.
11. Professional Responsibility
Course participants remain solely responsible for their own professional judgment and conduct.
Nothing taught by Mindful Momentum Institute authorizes a participant to diagnose, treat, prescribe, provide psychotherapy, or perform services outside their professional scope of practice.
When a client's needs exceed a participant's training, credentials, or professional scope, appropriate referral to a qualified professional may be necessary.
12. Technology and Availability
We use third-party technology providers, including Thinkific, to deliver our courses and services.
While we make reasonable efforts to maintain access, we cannot guarantee uninterrupted or error-free operation of third-party platforms, internet services, payment systems, or other technologies outside our control.
We may make reasonable changes to course delivery, technology, formatting, or platform functionality when necessary.
13. Acceptable Use
You agree not to use our website, courses, products, or services to:
Violate applicable law;
Infringe intellectual property or privacy rights;
Circumvent course completion or assessment requirements;
Attempt unauthorized access to accounts, systems, or content;
Introduce malicious software or interfere with platform operation;
Engage in fraudulent or deceptive activity; or
Facilitate unauthorized copying or distribution of our materials.
14. Third-Party Resources
Courses may reference or link to third-party research, websites, organizations, tools, or resources for educational purposes.
We do not control third-party services and are not responsible for their availability, content, privacy practices, policies, or actions.
15. Disclaimer of Warranties
To the extent permitted by applicable law, our courses, materials, and services are provided on an “as is” and “as available” basis without warranties of any particular outcome or uninterrupted availability.
Nothing in this section excludes warranties or rights that cannot legally be excluded.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Wellness With April, LLC, Mindful Momentum Institute, and their owners, instructors, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our courses, products, or services.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
17. Termination
We may suspend or terminate access when a user materially violates these Terms, engages in fraud or misuse, infringes our intellectual property rights, shares course access without authorization, or compromises the security or integrity of our services.
Termination does not grant a right to a refund where access was terminated because of a material violation of these Terms, except where applicable law requires otherwise.
18. Privacy
Your use of our services is also governed by our Privacy Policy, which explains how personal information is collected, used, and shared.
19. Changes to These Terms
We may update these Terms periodically to reflect changes in our services, business practices, technology, or legal requirements.
The effective date at the top of these Terms will indicate the most recent revision.
20. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, except where applicable consumer protection law requires otherwise.
